Betsy Beeks claimed that in March 2001, while performing laparoscopic surgery to repair a hernia, Alvarez proceeded negligently and perforated the lining of her bowels. She also claimed that he released her with prescriptions for painkillers but not antibiotics, and that the follow-up care was inadequate.
Beeks said the unnamed defendants failed to exercise the proper degree of knowledge and skill in examining, diagnosing, treating and caring for her, and that the hospital was negligent in hiring, supervising and granting hospital privileges to Alvarez. She also claims the hospital failed to investigate and monitor his "competence as a surgeon," and that the hospital was aware of prior allegations and misconduct by Alvarez.
She is asking for an amount exceeding $100,000 to be determined in court, and for court costs and attorney fees.
A 24-year-old Homer man has been charged with misdemeanor fourth-degree assault for allegedly assaulting his girlfriend.
On Feb. 4, Alaska State Troopers responded to a 911 call from a neighbor reporting a fight at the house Casey Noveske shares with his girlfriend. The caller said she could hear screaming followed by a loud bang, and said the screams sounded like someone being hurt.
The victim told troopers that she and Noveske had a verbal argument over the purchase of property, and that he had shoved her into a wall and then pushed her to the ground. She said she threw cat litter on him.
He dragged her outside, she said, and then threw her backpack at her. He also struck her in the head with the empty cat litter box, she said. Noveske said that she had hit him with the litter box and her backpack as well, and said he had not done anything wrong.
The victim had no visible injuries, troopers said. The defendant had two scratches on his side.
Two men were charged with first-degree vehicle theft in separate incidents in Homer recently.
Harold Harrington, 20, was charged with stealing a 1991 Subaru on Sept. 11, 2002. Ronald Campbell, 42, was charged with stealing a taxi on Dec. 1. The offenses are class C felonies.
