The trial started Aug. 22; the jury began its deliberations at about 2 p.m. Aug. 23. By 8:30 p.m., the jury foreperson announced the jury could not reach a verdict. The jury was released that night, and reconvened the next morning. After further deliberations, the foreperson said it still could not reach a verdict. The jury was released. A trial call for Jimmy is scheduled for Sept. 19 on the two charges.
The Kenai Grand Jury last week indicted Jeffery L. Rayburn of Homer, 43, for second-degree sexual abuse of a minor, a felony. The grand jury alleged that Rayburn had sexual contact with a person under age 13 on Aug. 1, 2004. Second-degree sexual abuse of a minor is a class B felony punishable by up to 10 years in prison and up to a $100,000 fine.
Alaska State Troopers at about 8:45 p.m. Aug. 29 went to a report of an assault at a Ninilchik home. In a criminal complaint, Sgt. Dane Gilmore of the Alaska Bureau of Investigation, Soldotna, alleged he found Theodore McGuire, 34, with injuries to his head and blood on his clothing. Following an investigation, Gilmore alleged that McGuire entered the room of a relative and assaulted the relative’s friend. During the incident, troopers allege two metal bed supports fell and hit the person on the head.
Troopers allege the friend had head injuries. Troopers allege the relative said a male relative stopped the assault and hit McGuire. Ninilchik emergency medical technicians treated McGuire and the relative’s friend for their injuries and took them to Central Peninsula General Hospital in Soldotna.
McGuire was charged with two counts of fourth-degree assault, domestic violence.
A man at about 1:20 p.m.Aug. 30 reported three cords of wood were stolen from a Fairview Avenue address. The man said the wood was to have been donated to a charity.
Homer Police at about 11:05 a.m. Aug. 31 went to a Main Street home for the report of an unattended death. Police found Rebecca Yates, 47, dead at her home. Yates remains were sent to the Alaska Medical Examiner for an autopsy, said Lt. Randy Rosencrans of the Homer Police. The cause of death has not yet been determined.
A caller at about 8:50 a.m. Sept. 1 reported to police she saw a boat with heavy smoke anchored in Kachemak Bay. A harbor officer investigated and determined the crew was sandblasting the boat.
