Rosencrans said police do not believe the possession was accidental, as in the unintentional receipt of pornography sent as "spam." Rosencrans said they have not yet determined if Kastar possessed child pornography with the intent to distribute. Investigation continues, Rosencrans said, and additional charges will be forthcoming and the arrest of additional suspects are anticipated.
Possession of child pornography is a class C felony punishable by a maximum fine of $50,000 and imprisonment up to five years, Rosencrans said. Each possession of child pornography is a separate charge. Alaska law defines child pornography as material that depicts aurally or visually sexual acts of a child under 18.
Alaska State Trooper Tom Dunn at about 1:30 a.m. Sept. 28 went to a large juvenile party at a gravel pit at the end of Alpine Meadows Road off of East End Road past McNeil Canyon. Dunn said he heard loud music and saw a large bonfire. Homer police assisted troopers. Dunn said numerous juveniles ran away when troopers responded, but they also contacted other juveniles. The parents of all juveniles were contacted. Dunn said minor consuming alcohol warnings were issued. Dunn stopped two vehicles leaving the scene, a Chevrolet Blazer and a Saturn. In a criminal complaint, Dunn said he smelled alcohol coming from occupants in both vehicles.
Dunn contacted the driver of the Blazer, Tristan Condon, 20, and his two passengers, an 18-year-old man and a 14-year-old person. He also contacted the driver of the Saturn, Michael McFarland, 19, and his passengers, also an 18-year-old man and a 14-year-old person. Dunn said all the passengers had bloodshot, watery eyes. The 14-year-old person in the Blazer passed out during the contact, and when the person's parents arrived, the child had to be carried to the parents' vehicle. Dunn alleged that both men told him they were the designated drivers and had not been drinking. He alleged the men said they knew they were going to a party, knew alcohol would be served and knew their passengers would be drinking. Condon is alleged to have told Dunn there is nothing else for kids to do in Homer. Troopers summonsed McFarland and Condon on charges of contributing to the delinquency of a minor.
