The seven-member Judicial Council reviews applications, investigates the background, experience and qualifications of the applicants and interviews them. All active and in-state inactive members of the Alaska Bar Association are asked to evaluate the applicants' qualifications. The public also is asked to comment about the applicants in writing or at a public hearing. The council then sends its nomination to Gov. Frank Murkowski, who has 45 days to appoint.
The Homer District Court judge seat became vacant with the medical retirement of Judge M. Francis Neville. Judge Ethan Windahl is the interim judge until a new judge is appointed and sworn in.
