The hearing is scheduled for 1:30 on Monday, Nov. 15 at the Homer Courthouse. A hearing scheduled last month was rescheduled just days before it was to occur. Staff at Kenai Superior Court said Wednesday that Judge Huguelet is also currently scheduled to hear a trial in Kenai on the same day, but that as of now the Griswold arguments have not been rescheduled.
The lawsuit requests that the court prevent the ordinance setting that limit or "any other ordinance adopted or enacted as a result" from being implemented. This could affect an increase in the size cap for retail area from 35,000 to 45,000 square feet in the city's central business district, where Fred Meyer has planned a 45,000 store.
