Officer Steve Smith received a cut on his forehead which required five stitches. Lt. Randy Rosencrans said Smith did not suffer a concussion and was otherwise fine.
Smith and Investigator Stacy Luck went to the courthouse for a report of a disturbance. According to a criminal complaint, Luck saw Germain seated at the defense counsel table. When police told him he was being arrested, Germain reached for his heavy coat. Smith told him to hand over the coat, but Germain refused and put it on. Smith again told Germain to give him the coat so he could search the pockets. When police tried to take him into custody, they allege he threw away the coat and kicked and swung his arms, then swung his head back and struck Smith above the right eyebrow.
Rosencrans said Smith and Luck took Germain down on the floor and were rolling around, and that he tried to punch at the officers. Luck then took out his M-26 Taser, a device that shoots two darts and administers a 50,000 volt shock, causing of loss of muscular control. The Taser is laser aimed. Rosencrans said Luck told Smith to stand back while he used the Taser.
Smith stepped away from Germain, Rosencrans said, and Luck aimed the Taser, shining a laser beam on Germain. Rosencrans said Luck had the presence of mind to also say to Germain, "I have a Taser and I'm going to use it."
Germain went prone and quit resisting. He was not injured in the scuffle. Rosencrans commended Luck and Smith for arresting Germain safely.
"They did a really good job without hurting him," he said. Judge Neville, a prosecuting attorney, Germain's attorney and a clerk of the court were also in the courtroom, Rosencrans said.
Police arrested Germain on charges of third-degree assault, a felony, and resisting arrest. He was taken to the Homer Jail. Rosencrans said the case will be forwarded to the Kenai grand jury.
