DA's office dismisses all charges against home-invasion defendants

BY MICHAEL ARMSTRONG

The Kenai District Attorney's office last week dismissed all charges against the three men in an Oct. 2 Ninilchik home invasion. On Dec. 14, the Kenai District Attorney's office dismissed first-degree burglary, a felony, and fourth-degree assault charges against Daniel Soger, 25. Fourth-degree assault charges against Joshua Moore, 23, and Timothy Taylor, 22, also were dismissed by the DA. Soger, Moore and Taylor are alleged to have broken into Shane Randall's Ninilchik home and attempted to assault him.

Randall sprayed with pepper spray and mace the three men when they came up the stairs toward him, Alaska State Troopers said in charging documents.

Randall also hit Soger on the side of the head with the blunt end of a hatchet and kicked him down the stairs. Moore also fell down the stairs. Soger was hospitalized for his injuries.

Judge Margaret Murphy last month dismissed burglary charges against Moore and Taylor after a grand jury failed to indict them on felony charges and a preliminary hearing was not held.
